1. Acceptance of these Terms

By accessing or using My Bracket App(the "Service"), you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

2. The Service

My Bracket App provides free online tools for building tournament brackets, round-robin schedules, and office pool sheets. The Service is provided free of charge and is supported by advertising. We may add, change, or remove features at any time.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

4. Accounts

Some features require an account. You agree to provide accurate information, to keep your password confidential, and to be responsible for activity that occurs under your account. Tell us promptly if you believe your account has been used without your permission.

5. Acceptable use

You agree not to:

• break the law or infringe anyone's rights using the Service;
• upload content that is unlawful, hateful, harassing, or otherwise objectionable;
• attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service;
• scrape or harvest data from the Service except as permitted by our robots file;
• interfere with advertising shown on the Service, or use automated means to generate ad impressions or clicks; or
• misrepresent your identity or affiliation.

6. Your content

You keep ownership of the brackets, schedules, team names, scores, and other content you create ("User Content"). By saving User Content on the Service, you grant us a limited, non-exclusive license to host, store, and display it for the purpose of operating the Service for you.

You are responsible for your User Content and confirm you have the right to use it. We may remove User Content that violates these Terms or the law.

7. Our intellectual property

The Service itself, including its software, design, text, and the My Bracket App name and logo, is owned by us or our licensors and is protected by intellectual property law. These Terms do not grant you any right to use our branding without our written permission.

8. Advertising

The Service displays advertising from third parties. We are not responsible for the content of advertisements or for the products, services, or websites they promote. Your dealings with advertisers are solely between you and the advertiser. See our Cookie Policy for how advertising cookies work and how to control them.

9. Third-party services and links

The Service relies on and links to third-party services and websites. We do not control those third parties and are not responsible for their content, policies, or practices.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any saved content will always be available.

11. Limitation of liability

To the fullest extent permitted by law, My Bracket App and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred US dollars (US$100).

12. Indemnification

You agree to indemnify and hold harmless My Bracket App and its operators from any claims, losses, and expenses, including reasonable legal fees, arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination, including Sections 6 through 12 and 14, will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Your continued use of the Service after a change means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of [set your state in lib/legal.ts], United States, without regard to its conflict of laws rules. You agree that the state and federal courts located in that state will have exclusive jurisdiction over any dispute that is not resolved informally, and you and My Bracket App agree to first try to resolve any dispute by contacting each other directly.
